1. Collection and processing of your personal data

Personal data, i.e. information about an identified or identifiable natural person, provided by customers via electronic forms available on the Store's website (including name, name, postal addresses, telephone numbers and e-mail addresses, as well as NIP number) are collected and used by the Personal Data Administrator only for the purpose of performing the contract and taking the necessary actions before concluding the contract, in particular for the purpose of:

The legal basis for the processing of your data is the contract between you and the Administrator, the conclusion of which takes place as a result of the acceptance of the Regulations and for the implementation of which the processing of your data is necessary, the consent you have given to the processing of data for marketing purposes or in connection with the subscription to the newsletter, or legally justified interests pursued by the Administrator or by a third party. Providing the data necessary to issue an invoice is a statutory obligation and results from the Act on tax on goods and services.
Providing personal data is not mandatory, however, failure to do so will make it impossible to conclude and perform the contract, in particular, failure to provide personal data will prevent the execution of orders, as well as contact with you and use of some of the functionalities offered by the Online Store www.chocogonenuts.com. In the remaining scope, the provision of personal data is voluntary, it is not a statutory or contractual requirement and is not a condition for concluding a contract.
Your data will be processed only if the Store or an entity cooperating with the Store has one of the legal bases indicated above and only for the purpose adapted to the given basis. Your data will be processed until there is a basis for their processing - i.e. in the case of consent until its withdrawal, limitation or other actions on your part limiting this consent, if the data is necessary for the performance of the contract - for the duration of its performance or the time necessary to perform it claims related to its performance, and if the basis for data processing is the legitimate interest of the Administrator or a third party - until this legitimate interest exists.
The administrator will transfer your data only to courier companies cooperating with him, as well as entities with whom he cooperates in the implementation of the payment and settlement process and entities with whom he cooperates in the maintenance and operation of the Store's website, including sending personalized and automatic messages via e-mail, SMS and other channels.
The administrator does not intend to transfer your data to a third country or to international organizations.
Each customer who provides his personal data in connection with the use of the Online Store has the right to access their data and rectify, transfer and delete them, as well as the right to limit data processing. In connection with the processing of your personal data by the Administrator, you have the right to lodge a complaint with the supervisory authority.
Based on your personal data, the Administrator will not make automated decisions regarding you, including decisions resulting from profiling. Nevertheless, we use cookies and other systems that record traffic on our websites.

You can express your will to withdraw your consent in any way, the only condition is that it reaches our attention.
If the Customer uses electronic payments, all data provided after switching to the payment operator's website remain only in its database and are in no way available or stored by the Store.
The administrator collects information on interactions with the Online Store and services, including: computer and login information, the so-called system logs containing the date, time of visit and IP number of the computer from which the connection was made and data on the statistics of website visits, traffic to and from individual websites. The above activities are aimed at improving the Store and adapting it to the customer's needs.
2. Subscription to the newsletter
The newsletter service is provided free of charge for an indefinite period or until the Customer resigns from the newsletter service, or until the newsletter service is terminated, which may occur at any time.
If you want to subscribe to the newsletter and agree to receive it in the registration or ordering process, please only provide your e-mail address to which commercial information from the Administrator will be sent.
The customer may at any time unsubscribe without giving any reason by logging into his account in the Store or by clicking the unsubscribe link in the footer of each newsletter. The cessation of sending information to the e-mail address provided is immediate and is signaled with a message confirming the operation.
3. Protection of clients' personal data
The administrator has implemented solutions adopted in the personal data protection policy and instructions for managing the IT system used to process personal data, which ensure effective protection of clients' personal data. The most important elements of the personal data protection system:

The collected personal data files are protected by the Personal Data Administrator in accordance with the provisions on the protection of personal data, in particular with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to processing personal data and on the free movement of such data, and repealing Directive 95/46 / EC (commonly referred to as "GDPR"). Only authorized employees of the Personal Data Administrator who are obliged to keep the information obtained in strict confidence have access to personal data.

The personal data administrator does not share personal data collected in connection with the use of the Store by third parties, except for entities providing services to the Administrator on the basis of separate contracts or with the consent of the persons whose data is transferred. In this case, the third party is obliged in the contract to ensure the level of security of the personal data provided at a level not lower than that applicable in the Administrator's company. In special situations where the applicable law requires the Administrator to disclose the collected data to state authorities, they will be made available.
4. The Store's IT system meets the highest standards of personal data protection.
Technical and organizational measures were applied to ensure the protection of the processed data in accordance with the requirements set out in the provisions on the protection of personal data and the guidelines of the authority for the protection of personal data.
The administrator has complied with all the obligations provided for by law in the field of personal data protection.

5. The right to access, modify, transfer, limit processing and delete data
Each customer providing personal data, the Administrator guarantees the right to access, modify, transfer and delete this data, as well as to limit processing. In the case of services operated automatically, these actions can be performed by the Customer himself, if such a form has not been made available, then it can be done by contacting the Administrator at the address provided in point 7.
In the event of a request to delete personal data, the Customer's personal data will be deleted or anonymized, unless further data processing is justified by generally applicable law.
6. Changing the privacy policy of the Online Store
The Administrator reserves the right to change this privacy policy, if required by applicable law or if the technological conditions of the Store's operation change. The current text of the privacy policy is always available on the Store's website. Changes to the privacy policy cannot deprive you of your acquired rights and they are effective for the future, from the date of the change. A customer who will not agree to changes to the privacy policy may stop using the Store at any time.
